Kindly read the below terms and conditions very carefully, these terms will help you understand your relation and responsibilities when you enter the agreement with HostAddon by using our services.

The terms “we, us, our” refers to HostAddon a Webhosting services provider and the terms “you, your, user, client, customer” refers to any person/s or entity who accepts this service agreement by using HostAddon services.

HostAddon holds the right to change, update or terminate any aspect of this site or the services, including without limitation of prices and fees for the same, at any time.

General Terms And Conditions :

ELIGIBILITY :

By registering with us or using our services, the customers permit or give their consent to the following conditions that:

1. They are at least eighteen (18) years of age and can form legally binding contracts under applicable law.
2. This agreement binds the customers/entity to provide latest, active, complete and accurate information while registering on our site. You can update your personal information whenever you want by using the customer support and billing support. Please be informed if our company found any piece of the information supplied by you as incorrect or incomplete, it reserves the right to cancel your registration immediately.
3. If you choose to pay using credit card or paypal, then we can ask for additional verification of the proof of payment by scanning of your credit card with govt. id for the sake of verification. However, here we would like to make it clear that if you fail at any stage of the verification process, this will lead to the cancellation of your account.

2. iMarcos, AutoSurf, Traffic Exchange, Automated Browsing HitLeap, Crawlers etc.
3. Bruteforce Programs/Port Scanning /IP Scanners
4. Email Spamming of any type
5. Investment Sites (E-Gold Exchange,HYIP, FOREX, Linden Exchange, Second Life/ Pyramid Scheme/ Ponzi, MLM)
6. Gambling Sites/ Lottery
7. MUDs / RPGs / PBBGs
8. Sites promoting hacking activities
9. Bank Debenture Trading Programs/ Bank Debentures
10. Replica Sites/ Fraudulent / Phishing
11. Public Proxies / TOR Exit/ Public VPNs/ Anonymizers
12. TeamSpeak / Mumble
13. Virtual Currency Mining (including but not limited to bitcoin)
14. DDoS-prone applications or booters / flood scripts / IP spoofing
15. Open DNS resolvers / recursors
16. Cracking tools
17. Public Game Servers
18. Cardsharing (CCCam or equivalent)
19. Any Adult content which depicts Underage Porn, Pics or Related Material
20. Malware / Exploits / Viruses
21. Child Pornography

General Usage Policy:

1. By agreeing to the terms mentioned below a customer agrees and acknowledges that they will abstain from using our services for:
2. Any violation of any rule, regulation, law, ordinance applicable to any state, federal, national or international.
3. Hosting of any software or site that may result in overloading and overburdening of our system or the software that has been provided to you by the company as the part of your service package.
4. Any such practices that fall into the category of child exploitation or child pornography.
5. The promotion or spreading of any piece of information that pose the sentiments of animal or human cruelty, religious, sect or caste hatred or terrorism.
6. Being involved in any personal information dispersion regarding any content related to users without getting prior permission.
7. Publishing, usage or any violation of any illegal hosting or software.
8. Being involved in mail bombing or any spamming that includes the sending of illegal emails to the general public.
9. Being found involved in any illegal or fraudulent activity online including usage or hosting of fishing sites, illicit or deceptive software.

Web Hosting terms and conditions | Shared, Reseller, Cloud

Service delivery: Shared, Reseller, Cloud hosting accounts are usually delivered instantly after the payment confirmation and verification. You will receive details of delivery with an automated email.

Obligations and liabilities

1. It is the sole responsibility of the customer to ensure the security and safety of the data by using a variety of security measures, backing up the data on a regular basis and with the periodical updating of the system.
2. In the case of shared hosting, the company is not responsible for any content on the customer website. As it is in this particular case the sole responsibility of the customer and he/she act as an independent individual.
3. If the customer is using a right or any license no matter provided by whom, he/ she is liable to pay for it. Failure to do so may give us the right to cancel or suspend the services without any preceding notice.
4. By agreeing to our terms and conditions, the customers give us the consent that he will obey all the laws and regulation applicable to the areas of placement of the software. Moreover, if the company found the customer is involved in any forgery, prohibited or fraudulent activity that is considered illegal in the area, he or she will be liable to the suspension of the account. The same goes for the IP address, if the company found any activity being carried on through the IP where the activity seems to be prohibited at the place of IP registration then the account automatically fall into the category of suspended accounts.
5. Only and solely the customer is responsible for the risks that come with his activities on the websites being hosted through his account. We have no responsibility regarding the content being transmitted, shared, collected or posted on the website. Moreover, the customer gives his consent that the will comply with all the rights possessed by the third parties, right regarding intellectual properties, patents, trademarks, and copyrights. We possess the right to only inform the customer regarding the probable legal activities that could happen as a result of their unlawful activities. Furthermore, the company disclaims that the data usage is the sole discretion of the customer and any third party involvement and the company has the right to suspend all accounts of a customer without any preliminary notice.
6. You should be careful in using the system resources and should control the usage below 25%. however, this restriction does not apply to the CPU, Disk, Bandwidth capacity, etc. Furthermore, you must not utilize the resource for more than 90 seconds in a 6 hours period.
7. Avoid running any queries including SQL, MS or MySQL for more than 15 seconds.
8. Avoid the usage of very large media files.
9. Avoid the sending of 300 messages per hour or more.

7. We create our data back-ups like disaster backup for both share and reseller server data, but we don’t guarantee the integrity of these backups. These only create for server restoration purpose. It is the responsibility of the hosting user to maintain the local copies of web contents and information. So, for this Backup/Restore the feature is added for each hosting plan. If a data loss error occurs due to issue at our side, we will recover your data free of charges. But it occurs due to clients’ mistake; we will charge a fee to recover the data. If the backup service is included in the plan, you can restore the data free yourself.
8. We have the authority to suspend the services without giving any notice with the provisions set out in the T & C, and if users are in breach of any TOS, any applicable law in force or third party rights.
9. We have the right to check and ensure that the customer is using services only according to the contract.
10. Due to certain security reasons the company choose to keep the SSH disable by default.

Dedicated Server, VPS Terms and Conditions:

Service delivery: Dedicated, VPS and VDS hosting services are usually delivered within 4hrs to 3 Days after the payment confirmation and verification. Delivery is effected by availability, location and custom installations/package. You will receive details of delivery with an automated email. If HostAddon fails to provide the client with the requested services within the 7 days, the customer has the complete authority to cancel the purchase and demand for refund.

The term “UNLIMITED” is used to describe the amount of resources in the web hosting plans provided by ResellersPanel, which is not set to a predefined limit value (for example – unlimited bandwidth, unlimited disk space, unlimited emails, or other unlimited resources). By not setting limits on key resources, we are able to offer our customers a simple, consistent pricing scheme as their websites demand more and more resources. As a result, a typical website may experience periods of great popularity and a resulting increased storage need without experiencing any associated increase in hosting charges.

In all cases, when a service is listed as “Unlimited“, it is intended for normal web hosting usage only – all activities, that may result in excessive resource usage inconsistent with regular usage patterns, are prohibited.

“UNLIMITED” USAGE POLICIES AND DEFINITIONS

For Shared/Reseller(Unlimited Plans)

The term “UNLIMITED” is used to describe the amount of resources provided by HostAddon, which is not set to a predefined limited value (for example – unlimited bandwidth, unlimited disk space, unlimited emails, or other unlimited resources). By not setting limits on key resources, we are able to offer our customers a simple, consistent pricing scheme in case their websites demand more and more resources. As a result, a typical website may experience periods of great popularity and a resulting increased storage need without experiencing any associated increase in hosting charges.

Our Premium Unlimited services are not designed to allow a single user to impact the overall server performance. HostAddon will make every effort to provide its customers with additional resources whenever possible, including and not limited to relocation of a customer’s hosting account to a newer, faster server. However, if the resource usage reaches a level where it may effect the overall server performance in a negative way, constantly, HostAddon reserves the right to take corrective actions. Such actions may include disconnection or discontinuance of any and of all offered services, removal or deletion of customers’ websites, website content, electronic mail, or termination of a customer’s account according to HostAddon’s sole and absolute discretion.

HostAddon Unlimited Shared/Reseller packages are in no way offered as a storage service as those service fall under different terms and resource management. These packages are purely used for users to host their own websites, and to store information, images, video, or other content accessible via the World Wide Web.

Customers must not allow other websites or hosting servers to link to files stored in their hosting accounts, and thus steal network traffic. In order to escape unjust distribution of the resources, Customers are not allowed to use their hosting accounts as a remote storage server only or solely for the purpose of sharing (un)archived images, programs or sound files. At least 80% of all files and/or total megabytes used (including MP3, WAV, RA, GIF, JPG, ZIP, RAR, but not limited to these file types) in each hosting account must be a part of actual, active website(s) content, i.e. all content files must have corresponding HTML or PHP files that link to them. Audio, graphics and/or video files must be must be under 25% of the current web hosting disk usage and must never exceed 50 GB in size. Furthermore, such media files may amount to no more than 50% of the customer’s total monthly traffic usage.

Hostaddon offeres storage services under the following packages : Storage VPS/VDS or Dedicated Servers

VPS/VDS/Dedicated Plans offered under “Unlimited” or “Unmetered” offer no limit bandwidth transfer according to the channel they are connected to.

Unmetered/Unlimited Bandwidth under Fair Usage Policy :
A fair usage policy is set in place to ensure equal and fair sharing of network resources. Hostaddon network does not set an explicit usage limit, however the fair usage policy still applies to prevent excessive consumption of resources that could negatively impact other users. Excessive, continuous and abusive usage will result in bandwidth throttling, or similar measures to ensure smooth operations.

Dedicated/Guaranteed Unmetered Bandwidth :
All resources under “guaranteed” policy will ensure client is entitled to guaranteed bandwidth or any other resource mentioned.

Our Refund Policy.

Terms of refund apply only in case we are not able to deliver the service as promised and explained below :
If the client does not receive one of the resources described : CPU/RAM/DISK/Dedicated Resources/Dedicated Network speed. Common connection on VPS and fair usage policy is exempt, as there are no guaranteed indicators for this service.
